Seeing as Woods, LaFortune LLP has a great deal of experience in NAFTA investor-state litigation, we thought it might be useful to provide a review of the basic elements of the investment provisions in NAFTA’s Chapter 11. Over the next few weeks, we will provide additional commentary on one of many hot topics in trade law debates – investor state dispute settlement (ISDS).
